Terms of Service

These draft terms will govern use of the FotoBay website, downloads, purchases, and software. Replace with counsel-approved language before launch.

FotoBay provides local photo backup software and an online licensing and support service. Photo libraries are not hosted by FotoBay. Your photos remain on storage that you own or control.

Purchases and refunds

Paid FotoBay licenses unlock premium features on your Bay. Licenses do not transfer ownership of your photos or library to FotoBay.

Because you can evaluate FotoBay during the free trial, payments after purchase are generally non-refundable. We may provide refunds for billing errors or other exceptional circumstances, and where required by law, as described in our Refund Policy. A refund deactivates the associated license and returns the Bay to the Free version. It does not delete your photo library or files stored on your computer.

Free trial and paid licenses

FotoBay includes a 14-day full-feature free trial. Your trial begins only after your first photo or video is successfully backed up to your FotoBay library. Installing, downloading, or launching FotoBay does not start the trial. Connecting a device alone does not start the trial. No payment information is required to start the trial. After the trial, a one-time paid license unlocks FotoBay on that Bay. Current trial and paid offerings are described on the Pricing page.
